GENERAL TERMS AND CONDITIONS
HAXX FIDELITY LOYALTY PROGRAM
- HAXX Petrol Stations, S.L., with registered address in Zierbena, Bizkaia, C/ Punta Sollana and tax ID number B-87761458, and GASOLINERAS AMISTAD S.L., with registered address in Madrid, C/ Orense 34, North Building, 1st Floor, Left, and tax ID number B-87019121 (hereinafter jointly referred to as “HAXX”), have created a loyalty programme called HAXX FIDELITY (hereinafter, the “Programme”), which may be joined, as participants, by any natural person (of legal age) or legal entity domiciled in Spain (hereinafter, the “Participant”).
Participation in the Programme may be requested by completing the registration form “Application for Registration in the HAXX FIDELITY Loyalty Programme” and submitting it at any service station within our network, or through any other channels enabled for this purpose. Once the completed form has been received, the corresponding HAXX FIDELITY card (hereinafter, the “Card”) will be issued for the applicant.
Participation in the Programme and the use of the Card are subject to these general terms and conditions (hereinafter, the “Terms”), which are published on the website: https://haxx-energy.com/fidelity/condiciones-generales, as well as any modifications that may be made at any time. Such modifications, which may be made at any time and without prior notice, will be published on the aforementioned website so that they may be consulted and must be read by the Participant.
The Card is not a means of payment and therefore cannot be used to pay for goods or services.
The purpose of the Programme is to offer the Participant, through the use of the Card, an additional discount on fuel purchases starting from 1 euro cent (€0.01) per litre refuelled, as well as access to exclusive promotions from HAXX and third parties, whether in our own establishments or outside them, as set forth in the corresponding legal terms of each promotion.
Responsibility for the use of the Card lies exclusively with the Participant from the moment it is delivered. Accordingly, HAXX shall not be liable for any contingency related to the Card once delivered, nor for any discounts obtained through improper use.
In the event of a breach of the Terms by the Participant, fraudulent use of the Card, or reasonable indications that such use may occur, HAXX may either temporarily block the Card until the circumstances that led to the blockage are clarified, or, if fraudulent use is confirmed, deregister the Participant and cancel the Card.
Both the Programme and the Card—and the benefits associated with them—are of indefinite duration. However, HAXX may cancel the Card or suspend its use by the Participant, or even terminate their participation in the Programme at any time and at its own discretion, in accordance with these Terms. HAXX also reserves the right to cancel the Programme at any time, upon prior notice to the Participant at least seven (7) days before the effective date of termination. Such notice may be provided through any of the contact details supplied by the Participant in the registration form, including communication through the HAXX service station network.
The Participant has the right to withdraw from the Programme at any time, in which case they must: (i) notify HAXX in writing via the following email address: administracion@haxx-energy.com; and (ii) stop using the Card and return it at any HAXX service station.
Cancellation of the Programme shall not entitle the Participant to any compensation or indemnification, without prejudice to any benefits already accumulated, which may, where applicable and at HAXX’s discretion, be redeemed within the period communicated together with the notice of termination.
HAXX may assign the rights and/or obligations arising from the Programme to any other company within the HAXX Group (with the HAXX Group being understood as all companies directly or indirectly owned by Hamlyn Participaciones S.L.U., tax ID number B95808184), by means of written notification to the Participant.
